Introduction
This Notice requirement applies only to employers subject to the federal Family and Medical Leave Act – in general, employers with 50 or more employees. Employers must inform employees in writing of the specific expectations and obligations associated with a FMLA leave request and the consequences of failure to meet those obligations within five business days of an employee’s initial request for leave or when the employer acquires knowledge that an employee leave may be for a FMLA qualifying reason. Employers may use this Notice, published by the Department of Labor, to satisfy the notice requirement.
