Introduction
This Notice requirement applies only to employers subject to the federal Family and Medical Leave Act – in general, employers with 50 or more employees. Employers must inform employees orally or in writing of their eligibility for FMLA leave or at least one reason why the employee is not eligible within five business days of an employee’s initial request for leave or when the employer acquires knowledge that an employee leave may be for a FMLA qualifying reason. This Notice, published by the DOL, can be used to satisfy the Eligibility Notice.
